TERMS OF SERVICE
1. Acceptance of Terms
These Terms of Service ("Terms") are a legal agreement between you and CardChart ("we", "us", "our") governing your use of the CardChart website and application at cardchart.app. By creating an account or using any part of the service, you confirm that you are at least 13 years old and agree to be bound by these Terms.
If you do not agree, do not use the service.
2. Description of Service
CardChart is a price tracking and technical analysis tool for Pokémon trading cards. It provides access to live eBay listings, historical sales data, portfolio tracking, and financial indicators (RSI, MACD, Bollinger Bands, and others) applied to card market data.
CardChart is provided as-is. We may add, change, or remove features at any time. We will make reasonable efforts to notify users of significant changes.
3. User Accounts
You must create an account to save watchlists and portfolio data. You are responsible for keeping your login credentials secure. You may not share your account or use another person's account without their permission.
You agree to provide accurate information when creating your account. We may suspend or terminate accounts that provide false information or violate these Terms.
4. Free Tier and CardChart Pro
Free Tier
The free tier is available to all registered users and includes card search, price charts, candlestick rendering, MA20, MA50, Bollinger Bands, watchlist, portfolio, and show list features.
CardChart Pro — $5.99 / month
Pro is a $5.99/month subscription that unlocks advanced indicators (RSI, MACD, Fibonacci, VWAP, TWAP, Kalman Filter, MA100), portfolio CSV export, and any future Pro-gated features. Subscriptions renew automatically each month. You can cancel at any time from your account settings — cancellation takes effect at the end of the current billing period, after which Pro access is removed.
Payments and Refunds
Payments are processed by Stripe. We do not store your payment details. All charges are in USD. We do not offer refunds for partial billing periods, but if you believe you were charged in error, contact us at support@cardchart.app and we will review the case.
5. Prohibited Use
You agree not to:
- Scrape, crawl, or systematically extract data from CardChart in an automated way
- Reverse engineer, decompile, or attempt to extract the source code of CardChart
- Use CardChart to build a competing product or service
- Circumvent any access controls or attempt to access features you have not paid for
- Transmit malware, spam, or any content that could harm CardChart or other users
- Use the service in any way that violates applicable law
6. Price Data and Accuracy
CardChart displays pricing data sourced from eBay and TCGPlayer via third-party data providers. This data is provided for informational purposes only. Prices are historical or live market data and are not financial advice.
We do not guarantee the accuracy, completeness, or timeliness of any price data shown. Card values can change rapidly. Do not make buying or selling decisions based solely on information displayed in CardChart. Always verify prices independently before transacting.
7. Intellectual Property
CardChart's code, design, branding, and original content are owned by CardChart and protected by copyright. You may not copy, reproduce, or redistribute any part of the service without written permission.
Pokémon is a trademark of Nintendo, Game Freak, and Creatures Inc. CardChart is an independent tool and is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, or any card grading service (PSA, BGS, CGC).
8. Disclaimer of Warranties
CardChart is provided "as is" and "as available" without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or free of viruses. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by applicable law, CardChart shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of your use of or inability to use the service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of CardChart shall not exceed the amount you paid to CardChart in the three months preceding the claim.
10. Termination
You may delete your account at any time by contacting support@cardchart.app. We may suspend or terminate your access if you violate these Terms, with or without notice.
Upon termination, your right to use the service ends immediately. Sections 6, 7, 8, 9, and 11 survive termination.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by displaying a notice in the app. Continued use of CardChart after changes take effect constitutes your acceptance of the revised Terms.
